Form 119C Revised 12/7/23 Order of Conditions

There have been revisions made that impacts a couple of our sentencing orders. First of all the DUI Supervision order has undergone some minor modifications, mainly to reflect the current practice of allowing those placed on the standard 12 months of Supervision to have 10 months to fulfill their conditions instead of 6 months as was printed on the old orders.  This will reduce the need for crossing out the number “6” everywhere on the order that designates a time frame to complete a condition, and replacing it with “10”, as has been happening for quite a while now. 
 
The big change you will notice is that we have developed an all-encompassing first time offender court order that will have four sentencing options on it.  It will replace the Second Chance Probation Orders that have been pulled from all of the courtrooms. It will also replace the “1410 Probation Order” that have also been pulled from the courtrooms.  It will also fill two voids, in that we did not have a Probation Order for First Time Weapons Offenders, nor did we have a Probation Order for First Offender Methamphetamine Possession.  This one order will have check boxes near the top to designate the court’s intent as to which type of probation the offender is being placed on, and also includes all of the applicable statutes.  Please see the attached copy.
 
Going forward we have plans to make revisions to some of the other orders as well, including merging the standard Probation and Conditional Discharge orders as the conditions of those two orders are nearly identical and the same concept as the First Offender order will apply here in that there will be some form of box to check so the court’s intent as to the type of sentence can be selected.  We will also be revising the Sex Offender Addendum and the Drug Court Addendum, after input is given by the Drug Court Team.
 
The new orders all have revised dates on them.  It is preferred that if old copies are floating around in people’s offices, that they are thrown out, and that only the new forms be used for the sentences above.  We will also include revised dates on any other court orders developed going forward.
